Cadbury’s Guess to Win Competition Terms & Conditions
1. This competition entitled “Cadbury’s Guess to Win competition” (the "Competition") is organised by WH Smith High Street Limited (company number: 06560339) whose registered office address is Greenbridge Road, Swindon, Wiltshire SN3 3RX (“Promoter”).
2. By entering this Competition, you accept, without limitation or qualification, the Competition terms and conditions set out herein (these “Terms”) without modification, and you confirm that you are eligible to claim any prize you may win. By entering the Competition, you acknowledge that you have read, accepted and are bound by these Terms. This is the case notwithstanding any subsequent acknowledgement by you of these Terms.
3. Competition Period: This Competition begins 9:00am on 20 March 2024 and ends at 23:59pm on 3 April 2024. Any entries submitted after this competition period will not be valid.
ELIGIBILITY CRITERIA
4. Any qualifying customer who completes the four following steps will be eligible to enter the prize draw for the Prize (as set out in section 7 below).
- • Like @WHSmithofficial’s competition post on Instagram
- • Follow @WHSmithOfficial on Instagram
- • Guess how many mini eggs are in the competition video (Also displayed in selected WHSmith travel locations) on Instagram in the comment section of the post
- • Mentions a friend in the same comment as their guess
5. The Entrant may enter multiple times by commenting on the competition post on Instagram, mentioning a different Instagram user each time and making a different guess. Their entry will not be counted if another user is not mentioned in their comment and/or a guess hasn’t been made.
6. Entrants must be aged 18 or over. Entrants must be residents of United Kingdom. This prize draw is not open to employees or contractors of Mondelez Europe Services GmbH – UK Branch or the Promoter, their immediate families, nor to any other person connected with the Competition.
PRIZE
7. There will be one prize winner (the “Winner”), who will win a year’s supply of Cadbury’s chocolate to share with family and friends, which will include twelve (12) cases to be delivered to the Winner in two deliveries, the first in April 2024 and second in October 2024. Each case will include a minimum of 2.16kg of chocolate with a minimum RRP of £36. Total prize value will have a minimum £432 RRP.
8. Unsuccessful entrants will not be contacted. The decision of the Promoter trading as www.whsmith.co.uk on all matters is final.
9. The Winner will be selected through a random draw of all valid entries that include a correct guess of the number of mini eggs in the designated graphic shown in selected WHSmith travel locations and the Instagram post. If there are no correct guesses Winner will be selected at random from all guesses within +/-25. Ie. if correct number was 325 winner will be drawn from guesses 300-350.
10. The winner will be selected within fifteen (15) working days after the closing date of the competition. The Winner will be notified by direct message on Instagram and within the comments on the Instagram post, and MUST respond by midnight within seven (7) days of the date of contact, providing a valid UK address for the prize to be dispatched to. If the selected Winner does not meet all the entry conditions or refuses the prize, another entrant will be selected at random from the remaining eligible entries within a reasonable timeframe. The Prize will be sent within twenty-eight (28) days of receipt of the Winner’s response containing their dispatch address.
DATA PROTECTION
11. The Promoter will only use your email address and other personal information in compliance with the provisions of the General Data Protection Regulation and the Data Protection Act 2018 (including any amended, equivalent or subsequent legislation) and will use, store or otherwise process any personal information that relates to and identifies you, including but not limited to your name, age, postal address, e-mail address, telephone number and any other information collected on entry to this Competition, to the extent reasonably necessary to run this Competition, to contact entrants if necessary to notify the Winner, or to check eligibility requirements have been met, and will not be shared with other companies except for Mondelez Europe Services GmbH – UK Branch for the sole purpose of the fulfilment of the Prize. The Promoter will only process your personal information for the purposes described in these Terms and will not give your personal information to any third parties save as permitted in clause 12 below.
12. Your information may, for the purposes set out in these Terms, be disclosed for processing to:
a. the Promoter’s employees, affiliates, group companies and their employees and successors in title to their businesses:
b. third Party consultants, contractors or other service providers who may access your personal information when providing services (including but not limited to IT support services) to the Promoter:
c. government bodies and law enforcement agencies and in response to other legal and regulatory requests; and
d. auditors or contractors or other advisers auditing, assisting with or advising on any of our business purposes, in any jurisdiction where we operate.
e. The winners contact details will be shared with Mondelez Europe Services GmbH – UK Branch for the sole purpose of fulfilment of the prize
13. The Winner may be asked to participate in any publicity or promotion organised by The Promoter which may include printing the Winner’s name on the Promoter’s website, social media accounts or other group promotional material. If a Winner does not consent to participate in any/all publicity or promotional activities, they should notify the Promoter without delay in writing at support@whsmith.co.uk.
14. By submitting any personal information to us you consent to the use of the information as set out in these Terms.
GENERAL TERMS
15. The Promoter may be required to terminate, amend or withdraw this Competition and/or these terms and conditions in exceptional circumstances beyond its reasonable control.
16. The invalidity or unenforceability of any provision of these Terms shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Terms shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
17. These Terms and any disputes or claims arising out of or in connection with them or their subject matter or formation (including non-contract disputes or claims) shall be governed by and construed in all respects in accordance with English Law.

4. Any qualifying customer who likes the competition post, follows @whsmithofficial on Instagram, and mentions another Instagram account from their friend list in the comments of the competition post will be eligible to enter the prize draw for the Prize (as set out in section 7 below).
5. The Entrant may enter multiple times by commenting on the competition post on Instagram, mentioning a different Instagram user each time. Their entry will not be counted if another user is not mentioned in their comment.
6. Entrants must be aged 18 or over. Entrants must be residents of United Kingdom. This prize draw is not open to employees or contractors of the Promoter or WH Smith High Street Limited, their immediate families, nor to any other person connected with the Competition.

Please read these terms and conditions carefully before participating in any WHSmith Online Digital Event.
1. The ‘Meet the Author’ event “Event” hosted on WHSmith.co.uk or any of its official social media channels (“Social Media”) is organised by WHSmith High Street Limited (company number: 06560339) whose registered office address is Greenbridge Road, Swindon, Wiltshire SN3 3RX (the “Promoter”).

By participating in this Event, you accept, without limitation or qualification, the terms and conditions set out herein (these “Terms”) without modification, and you confirm that you are eligible to do so. 7. All Intellectual Property Rights in Events and in the Content are the property of WHSmith or it’s third-party content providers. WHSmith may provide a licence to third parties, including but not limited to Event Sponsors and third-party collaborators, to use the Content at its sole discretion.
8. WHSmith, or it’s third-party partners are not responsible for the reliability or continued availability or speed or quality of the telephone or internet lines and/or equipment that you use to access any Event or Content, or any technical issues which may arise as a result of your failure to ensure compatibility of our technology with your systems. WHSmith accepts no responsibility where an Event or to Content may not be available as a result of downtime for repairs, maintenance and/or repairs to WHSmith.co.uk, it’s official social media channels or other websites, Online Event Platforms and systems.
9. Participants are responsible for all access to any Event, Online Event Platform and/or Content by them or anyone else using their user names and passwords and for preventing unauthorised use of any such user names and passwords. If you believe there has been any breach of security (such as the disclosure, theft or unauthorised use of any user name, password or any payment information), you must notify WHSmith immediately by emailing the customerqueries@whsmith.co.uk.
10. You must not misuse our site or official social media channels (our “Sites”) by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, any servers, computer or database connected to our Sites. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Sites will cease immediately.
11. Participants may not use WHSmith.co.uk or its Social Media: (a) for any unlawful purpose; (b) to impersonate any person, company, group or entity or misrepresent a relationship to or with any of the same; or (c) to collect, store, disclose or otherwise process any personal data in relation to your use of any Interactive Area without the express consent of the relevant individual.
Although WHSmith’s Event programmes are correct at the time of publication, WHSmith reserves the right to change the format, Content, speakers, hosts, moderators and/or timing of an Event. WHSmith will endeavour where possible to notify all Participants of any such changes prior to an Event. In exceptional circumstances, WHSmith may need to cancel or postpone an Event, in which case we shall notify you as soon as reasonably practicable and shall endeavour to reschedule the event within two months of the original Event date.
